The important bits

Welcome to Grow with Kerry.

I'm Kerry, and I help small businesses find clarity, make better decisions and move forward with confidence.

These terms explain how my website, consultancy services and digital resources work. I've kept them as straightforward as possible.

Grow with Kerry is operated by Kerry Howell, registered as With Kerry.

1. Using this website

The content on this website is provided for general information and guidance.

You're welcome to explore, read and learn from it. Please don't copy, reproduce, distribute or sell my content or resources without permission.

I aim to keep the information useful and accurate, but business practices, platforms and circumstances change. Website content should not be treated as a personalised recommendation for your business.

2. Working together

Grow with Kerry provides business and marketing strategy, consultancy and related support.

My services include The Journey, The Riff and individually agreed projects.

The exact scope, deliverables, price, timings and responsibilities will be confirmed before work begins, either in a written proposal, scope of work or booking confirmation.

For bespoke consultancy projects, the agreed written scope will take precedence over these general website terms where there is a conflict.

3. What you can expect from me

I'll provide the agreed services with reasonable care and skill, communicate clearly and flag any material changes to the agreed scope before undertaking additional chargeable work.

My role is to offer experience, perspective, recommendations and practical support. I'll make recommendations based on the information available, but decisions about your business remain yours.

4. What I need from you

Good work is a collaboration.

Depending on the project, I may need timely access to information, feedback, content, accounts, platforms or relevant people in your business.

You'll be responsible for ensuring that information and materials you provide are accurate and that you have the necessary rights and permissions for me to use them.

If required information or access is delayed, we may need to adjust the agreed timeline.

5. Scope and changes

Every project has agreed boundaries so we're both clear about what's included.

If something comes up outside the original scope, I'll discuss it with you before undertaking additional chargeable work.

Any changes to fees, deliverables or timelines will be agreed before proceeding.

6. Fees and payment

Consultancy fees, payment schedules and any deposits will be confirmed in your proposal, scope of work or booking confirmation.

For bespoke projects, invoices are normally due within three days of issue, unless otherwise agreed in writing.

Where an invoice remains unpaid for more than 14 days, I may pause work after giving appropriate notice, subject to applicable law and the agreed contract.

Any applicable taxes will be stated at the point of purchase or in the relevant proposal or invoice.

7. Cancellations, postponements and project pauses

For bespoke business-to-business projects, cancellation and postponement arrangements will be set out in the agreed scope of work.

Where a business client cancels after work has started, payment may be due for work already completed or reasonably committed to, as specified in the agreed contract and subject to applicable law.

If a project is paused at the client's request for more than four weeks, the original delivery timetable may need to be reconsidered.

Nothing in these terms removes any statutory cancellation or refund rights that apply to consumers.

8. Go Solo digital resources

Go Solo includes free and paid downloadable resources designed to help you think through and work on your business independently.

When you purchase a digital resource, you'll receive access to the item described on its product page.

Unless explicitly stated otherwise, a purchase gives you a personal, non-exclusive, non-transferable licence to use the resource for your own business purposes.

You may not resell, redistribute, publish, share publicly or repackage a resource as your own product without written permission.

You are welcome to apply the ideas and exercises to your own business.

9. Digital downloads, cancellations and refunds

For consumers purchasing digital content online, statutory cancellation rights may apply.

Where you choose immediate access to a paid digital download during the usual cancellation period, I will ask for your express consent to immediate delivery and your acknowledgement that you will lose your statutory right to cancel once supply begins, where applicable.

This information will also be confirmed as required by law.

If a resource is faulty, not as described or otherwise fails to meet your statutory rights, you may be entitled to a remedy.

Please contact growwithkerry@gmail.com if you experience a problem with a purchase.

Nothing in these terms affects your statutory consumer rights.

10. Intellectual property

The Grow with Kerry name, website content, original resources, frameworks, templates and materials belong to Grow with Kerry or their respective rights holders, unless otherwise stated.

For bespoke client projects, ownership or licensing of specifically commissioned deliverables will be set out in the relevant scope of work.

Unless otherwise agreed, ownership of agreed bespoke deliverables transfers following receipt of final payment, excluding pre-existing materials, third-party content, tools and any elements expressly retained by their original owners.

You retain ownership of your own business content and materials.

I will only feature client work in my portfolio or marketing with the client's prior permission.

11. Advice, results and third-party platforms

My work is designed to support clearer thinking and better business decisions.

I cannot guarantee particular commercial outcomes, including increased sales, revenue, leads, bookings, website traffic, search rankings or visibility in AI-powered search.

Results depend on many factors, including your implementation, customers, competitors, market conditions and third-party platforms.

I am not responsible for third-party platform outages, changes to policies, algorithms or functionality that are outside my reasonable control.

Where I make recommendations involving legal, tax, financial or other regulated matters, you should seek advice from an appropriately qualified professional.

12. Liability

I will provide my services with reasonable care and skill.

For business-to-business consultancy contracts, any agreed limitation of liability will be set out in the relevant contract and will apply only to the extent permitted by law.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Nothing in these terms limits a consumer's statutory rights.

13. Confidentiality

During consultancy work, you may share commercially sensitive information about your business.

I will treat confidential information appropriately and will not disclose it to third parties except where reasonably necessary to deliver agreed services, where you authorise disclosure or where disclosure is required by law.

You agree to respect the confidentiality of any non-public methods, pricing or materials shared as part of our work together.

More detailed confidentiality arrangements may be included in individual project agreements.

14. External links and services

This website may link to other websites, tools and platforms.

Those services operate under their own terms and privacy policies. I am not responsible for their content, availability or practices.

15. Changes to these terms

I may update these website terms from time to time.

Any changes will apply prospectively and will not automatically replace terms already agreed in a signed client contract.

16. Governing law

These terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply.
